Nascentist provides AI-powered code assistance through API endpoints and a web interface. The Service includes:

Code completion and fixing
Code review and analysis
Test generation
Code explanation
Memory-augmented AI assistance

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

Provide accurate and complete information
Maintain the security of your account
Notify us immediately of any unauthorized access
Be responsible for all activities under your account

4. API Usage and Rate Limits

The Service provides API access with the following restrictions:

Free Plan: 3 RPM, 50 RPD, 10K TPM
Developer Plan: 10 RPM, 2K RPD, 40K TPM
Pro Plan: 30 RPM, 10K RPD, 200K TPM
Team Plan: 100 RPM, 99K RPD, 999K TPM

We reserve the right to modify these limits at any time.

5. Acceptable Use

You agree NOT to:

Attempt to extract our proprietary memory layer architecture
Attempt to access our provider API keys
Use the Service for malicious purposes
Scrape or copy content from the Service
Reverse engineer any aspect of the Service
Share your API keys with others

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Nascentist and are protected by international copyright, trademark, and other intellectual property laws.

Your code remains your property. We do not claim ownership of code you submit to the Service.

7. Data and Privacy

We collect and process data as described in our Privacy Policy. By using the Service, you consent to our data practices.

We implement security measures to protect your data, including encryption, access controls, and regular security audits.

8. Payment and Billing

Paid plans are billed through Razorpay. By subscribing to a paid plan, you agree to:

Pay the fees specified for your chosen plan
Allow automatic renewal unless cancelled
Provide accurate billing information

Refunds are available within 7 days of purchase if you're not satisfied with the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NASCENTIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
